Former US Vice President Mike Pence has urged the Supreme Court to drop Rowe's landmark 1973 case against Wade, which legalized abortion in the United States.
Mr. Pence said the decision was a "wrong decision" that had cost millions of unborn babies. If Rowe is ousted against Wade, millions of women will lose access to abortion.
A decision is expected next summer. Mississippi's prohibition includes abortion through rape or incest. However, the law wasn't enforced due to legal challenges by the country's only abortion provider.
The 1973 decree gave women in the United States an absolute right to an abortion during the first three months of pregnancy and a limited right during the second three months.
"We ask the Supreme Court of the United States to overturn Rowe v. Wade and return the sanctity of human life to the focus of American law," the former vice president said.
Mr. Pence also argued that the "Unelected Judge's Decision" did not reflect public opinion in the United States. She believes elected state officials are better able to draft abortion laws for their jurisdictions.
A national abortion ban is invisible, but voting for the Mississippi River means the US could develop its abortion laws. Experts predict that abortion will soon become illegal in more than 20 other states.
Twelve states have passed so-called trigger laws that will automatically ban abortions if Roe is repealed. Others in the years after Roe v. Wade enforced an unconstitutional abortion ban (which will be reinstated) or have maintained pre-Roe abortion restrictions, which are currently unenforceable. Mississippi Attorney General Lynn Fitch has repeatedly called for Rowe's fight against Wade to be repealed. Fitch said the precedent he set was "grossly wrong."
